This website is operated by viC, an independent artist based in the United Kingdom. It is used to showcase artwork, and allow clients to enquire about and commission original artwork.
By accessing or using this website, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site.
2. Intellectual property
All creative content displayed on this website is the original work of viC and is protected by copyright law. You may not reproduce, copy, distribute, or use any content from this website for commercial purposes without prior written permission.
Sharing images from this website for non-commercial purposes (such as on social media) is permitted provided that viC is clearly credited as the creator.
3. Commissioned artwork — agreement and deposit
A commission is considered agreed once both parties have confirmed the details in writing (via email or the contact form) and the deposit has been received. No work will begin before these two conditions are met.
A non-refundable deposit of 50% of the agreed total is required to secure your place in the commission queue and to cover the cost of materials. By paying the deposit, you confirm that you have read and agree to these terms in full.
The remaining balance is due upon completion of the artwork, before it is shipped or released for collection.
4. Reference photos and agreed details
The client is responsible for providing high-quality reference photos of the subject. At least one clear, well-lit photograph with good shadow and highlight detail is required. viC cannot be held responsible for any limitations in the final result that arise from poor-quality reference material.
By submitting reference photos, the client confirms that they have the right to share those images and grants viC permission to use them solely for the purpose of creating the commissioned artwork. Reference photos are stored securely, used only for the commission they relate to, and deleted once the commission is complete, in line with viC’s Privacy Policy.
If the client consents to viC using reference photos for promotional purposes alongside the finished piece — such as showing a before and after on social media or in a portfolio — this must be agreed explicitly in writing. viC will always ask before using reference photos publicly and will never do so without clear permission.
All details — including subject, composition, board colour, and size — must be fully agreed upon in writing before work begins. viC will proceed based solely on what has been agreed at that stage.
5. Revisions and changes
Due to the nature of dry pastel on Pastelmat, changes to the artwork once work has begun are not possible. It is the client’s responsibility to ensure all details are correct and agreed before the commission starts. Please take your time at the discussion stage.
If a client requests a significant change to the agreed brief after work has begun, viC reserves the right to treat this as a new commission requiring a new deposit and agreement.
6. Cancellations
If a client wishes to cancel a commission after the deposit has been paid and work has begun, the deposit is non-refundable under any circumstances, as it covers materials already purchased and time already invested.
If a cancellation is requested before work has begun but after the deposit is paid, viC will consider a refund at their sole discretion depending on whether materials have been purchased. This is not guaranteed.
viC reserves the right to cancel a commission at any time if communication from the client breaks down or if the commission is found to be outside the scope of what viC is comfortable creating. In such cases, a full refund of the deposit will be issued.
7. Turnaround time
Estimated turnaround times are provided in good faith but are not guaranteed. viC holds full-time employment alongside commission work, and completion times may vary depending on size, complexity, and current queue position.
Priority turnaround may be available for an additional fee. This must be requested and agreed at the time of enquiry, not after the commission has begun.
viC will make every reasonable effort to keep clients informed of progress and any delays.
8. Shipping and collection
Completed artwork is carefully packaged in glassine paper with appropriate cushioning and clearly marked as fragile. Shipping costs are the responsibility of the buyer and will be included in the final invoice with a receipt provided.
viC takes all reasonable care in packaging but cannot be held responsible for damage caused in transit once the artwork has left viC’s hands. Clients are encouraged to consider insured shipping for larger or higher-value pieces.
In-person collection is also available and is arranged directly between viC and the client. Full payment must be received before the artwork changes hands.
9. Payment
The following payment methods are accepted:
- Bank transfer
- PayPal Goods & Services
- Cash (in-person collection only)
Work will not begin until the deposit payment has cleared. The completed artwork will not be released or shipped until the remaining balance has been received in full. viC reserves the right to pursue outstanding balances through appropriate legal channels if necessary.
10. Portfolio and promotional use
viC reserves the right to photograph and display completed commission work in their portfolio, on this website, and on social media for promotional purposes. If a client wishes for their commission to remain private, this must be stated clearly in writing before work begins, and viC will honour this request.
11. Limitation of liability
viC’s liability in connection with any commission is limited to the total amount paid by the client for that commission. viC is not liable for any indirect, incidental, or consequential losses arising from the use of this website or from a commission agreement.
This website is provided in good faith and viC makes every effort to keep it accurate and up to date, but cannot guarantee that all information on the site is error-free at all times.
12. Privacy
Any personal information collected through this website is handled in accordance with viC’s Privacy Policy, which forms part of these terms by reference.
13. Changes to these terms
viC reserves the right to update these Terms of Service at any time. Any changes will be reflected by an updated date at the top of this page. Continued use of the website or placement of a commission after changes are posted constitutes acceptance of the updated terms.
14. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from the use of this website or from a commission agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
